This is an except from a standard Universal contract: (this is NOT the boys actual contract, I am just giving you the standard example)
Breach:
In the event that the purchaser shall have the right ( without limiting any of the other legal remedies hereunder) to refrain from rendering of a performance, Purchaser shall be liable to (TOKIO HOTEL) for all of the fees and compensation hereunder in the same manner as if (TOKIO HOTEL) had fully performed. A breach of any clause contained herein shall be deemed a material breach. If (TOKIO HOTEL) elect to perform or to continue to perform notwithstanding a breach of this agreement by the purchaser, the performance shall not constitute a waiver of any claim (TOKIO HOTEL) may have for damages or any other recourse which might be open to (TOKIO HOTEL).
In the event Purchaser refuses or neglects to provide any of the items or to perform any of the obligations herein stated, and/or fails to make any of the payments as provided herein, artist shall have the right to refuse to perform this contract, shall retain any amounts theretofore paid to the artist by Purchaser and Purchaser shall remain liable to Artist for the agreed price herein setforth.
Jurisdiction
In the event of a dispute regarding any part of the agreement between the purchaser and (TOKIO HOTEL), the contract and rider shall be litigated in accordance with the applicable laws in effect on the date of the issuance of the contract in the State of Berlin in the Federal Republic of Germany.
So. The promoters can go ahead and howl, but the boys will be paid, regardless.
Most bands get a partial payment in advance, and then receive the balance on the night of the performance when they show up. I think what probably happened was that the promoters didn't have the rest of the money, because not enough people showed up, and the band was instructed to not perform by their management team and lawyers.
That is my best GUESS right now.
