Общество защиты прав потребителей подало в суд на спорткомплекс "Олимпийский". Правозащитники считают, что организация должна вернуть гражданам стоимость билетов за несостоявшийся 10 марта концерт группы Tokio Hotel. В "Олимпийском" считают, что все издержки должен оплачивать организатор мероприятия — компания Top Concert.

Исковое заявление общества защиты прав потребителей (ОЗПП) против спорткомплекса "Олимпийский" направлено в Мещанский суд Москвы. Как рассказали "Ъ" в обществе, иск направлен в защиту "неопределенного круга потребителей" и не предполагает какую-либо материальную ответственность ответчика. "Если решение суда будет в нашу пользу, то любой гражданин, купивший билет на концерт Tokio Hotel в кассах "Олимпийского", сможет потребовать вернуть деньги в спорткомплексе",— пояснили "Ъ" в пресс-службе ОЗПП.

Немецкая группа Tokio Hotel должна была дать два концерта в России в рамках европейского турне — 8 марта в Санкт-Петербурге и 10 марта в Москве. Однако за несколько часов до начала концерты были отменены: менеджмент группы заявил, что промоутер — компания Top Concert — нарушила контрактные обязательства, а представители Top Concert возложили вину на "несогласованность действий менеджмента группы". Стоимость билетов на концерт составляла от 1,5 тыс. до 22 тыс. руб., общее число проданных билетов неизвестно, "Олимпийский" вмещает до 17 тыс. зрителей. Ранее глава Top Concert Татьяна Дальская заявила, что "все деньги за билеты будут возвращены", а на сайте компании появилась инструкция, каким образом это можно сделать и в какие сроки.

При этом за последний месяц в ОЗПП обратились с жалобами несколько тысяч человек, но в кассах "Олимпийского" деньги им не вернули. В пресс-службе организации рассказали, что на билетах спорткомплекса не были указаны название и координаты организатора концерта. "Информация на билетах, продаваемых на концерт немецкой группы, содержит данные только об одном юридическом лице — ОАО "Спортивный комплекс "Олимпийский"",— пояснили в обществе.— Следовательно, потребитель мог прийти к выводу, что организатор концерта — вышеуказанная организация. Потребители были введены в заблуждение". Как пояснил "Ъ" юрист ОЗЗП Андрей Семенов, билет — это "единственный юридический документ, подтверждающий право гражданина посетить концерт, поэтому указанная на нем компания ответственна за то, что информация об организаторе не была доведена до потребителя, и теперь должна возместить все их убытки". Господин Семенов добавил, что подобные проблемы возникли только с "Олимпийским" — на билетах, проданных через других агентов, название промоутера указано.

"Документов из суда мы пока не получали,— заявила "Ъ" начальник юридического отдела СК "Олимпийский" Яна Кусилова.— Спорткомплекс выступает как агент: к ответственности его можно привлечь, если бы кто-то купил, например, два билета на одно место. Ответственность за отмену концерта лежит на организаторе. Да и деньги за проданные билеты уже переданы промоутеру, и нам нечем расплачиваться с потребителями".

С представителями Top Concert вчера связаться не удалось: мобильный телефон Татьяны Дальской был выключен. "Есть вероятность, что концерт группы все-таки состоится,— заявили представители компании в пятницу.— Переговоры с коллективом возобновились. К концу недели будет точно известно, будет ли концерт перенесен на апрель или же отменен окончательно. Если он состоится, то попасть на него можно будет по тем билетам, которые были куплены на мартовские концерты, либо Top Concert будет возвращать полностью все деньги за билеты".
